How technology is transforming personal injury law

March 10, 2025

The technology that seemed like the stuff of science fiction only a handful of years ago—take artificial intelligence as a prime example—is now literally at our fingertips, having been incorporated into smartphones, watches, augmented reality glasses and smart home devices. These dynamic new innovations have also significantly transformed how personal injury law cases are managed and adjudicated, and how insurance companies process claims.

Indeed, the data we’re constantly generating and collecting can have a significant impact on personal injury legal proceedings in Ontario, helping to determine everything from rulings of liability to determinations of post-injury compensation.

Various types of digital evidence have become crucial in personal injury cases, potentially helping injured parties obtain the compensation they need to recover after a life-changing incident. That data could include social media posts, personal medical information generated by a wearable device such as a FitBit or Apple Watch, electronic medical records or on-site video footage, to name only some of the many ways that our every movement is being monitored by the devices we carry.

Consider the digital evidence collected by an Apple Watch. Data on an injured individual’s activity levels and location could be used by their lawyer to confirm that they were highly physically active, or worked a physically (or mentally) demanding job (or both) prior to sustaining a major personal injury. That evidence could then be used by their personal injury lawyer to argue that the plaintiff should receive increased compensation to cover lost income (or related opportunity costs) and help them return to pre-injury levels of activity.

Leveraging data to advocate on your behalf

As we noted in a previous blog, collecting digital evidence—by taking photos or video after an auto accident or a slip and fall incident, using two common personal injury scenarios—is crucial to supporting claims and establishing liability. Our team will often use surveillance camera footage or even dash cams to determine the circumstances (including road conditions or other drivers’ behaviour) that may have led to an auto accident, along with who may be responsible.

It’s important to note that defence lawyers seek to use footage and other digital information to support their own liability arguments and attack the credibility of a personal injury claim. In other words, digital evidence can (and will) be used against you if your case goes to court. As we noted in an earlier blog on the many ways that social media is impacting personal injury cases, a simple post-injury post can have significant consequences. It’s common for social media content to be used against plaintiffs if photo or video evidence counters their claims of disability or injury.

Digital platforms can improve patient outcomes

In addition, we can’t overlook the impact that digital health platforms are having on injured parties’ ability to obtain diagnoses and assessments, interact with medical professionals and better manage digital medical records. Most importantly, telehealth platforms allow injured parties to avoid unnecessary travel to help ensure their comfort and potentially even speed their recovery. Electronic health records are also easier to organize and share, helping their legal representatives build a more coherent case on their behalf, or better manage claims with their insurer.

Artificial intelligence is another burgeoning technology helping to transform personal injury law. It’s enabling the analysis of large data sets to predict outcomes, helping firms conduct case law research and assess claims more efficiently. AI technologies can help legal teams perform tasks ranging from document analysis to developing case-specific legal strategies, thereby streamlining case management and speeding settlements or litigation. However, there are widespread implications of AI that remain a cause for concern across the legal community. Data management and privacy are two major issues that will need to be carefully managed in the years ahead. Firms will also need to ensure that the integrity of legal proceedings aren’t compromised by the use of AI-powered automated processes.

As we look to the future, we can only expect technology to continue to influence—and even reshape—the personal injury field. Advances in biometric monitoring could lead to even more precise assessments of the physical and psychological impacts of injuries. As AI becomes more sophisticated, its role in predicting legal outcomes could become a standard tool in case strategy. However, with these advancements, the legal community must also anticipate changes in legislation and be prepared to manage the ethical implications associated with technological integration.
